Chapter Part 3 Hawaii Laws Specific to Life Insurance & Annuities

Thirty-five of the eighty-five scored questions on the Hawaii life exam are Hawaii law — about 41%, in a section with its own 45-minute clock. That weighting is the argument for learning the state provisions properly rather than treating them as trim on the national material. The good news is that Hawaii’s life rules are compact, prescribed by statute in a single standard-provisions section, and built around four numbers.

The standard provisions — 2, 30, 3 and 6

Hawaii prescribes its life policy provisions in HRS § 431:10D-102, and the exam draws on them directly. An individual life policy carries a 2-year incontestability period from the date of issue, a 30-day grace period, and a 3-year reinstatement window running from premium default, available on evidence of insurability and payment of the overdue premiums.

Then the fourth number, which national material rarely supplies at all: those overdue premiums bear interest not exceeding 6% per year, compounded annually. Hawaii caps it in the prescribed provision itself.

The required nonforfeiture options under § 431:10D-104 are the classic three: cash surrender value, reduced paid-up insurance, and extended term insurance.

The 10-day free look — and its unusual reach

Hawaii’s free look is 10 days, which is short by national standards. But the tested subtlety is not the length — it is the breadth. HRS § 431:10-214(a) applies the same 10 days to individual life policies and individual accident and health policies. One provision, two of the state’s eight lines of authority.

Two products then step up to 30 days: long-term care under § 431:10H-111, and Medicare supplement under HAR § 16-12-8. A producer working the senior market lives at the 30-day end almost exclusively.

Variable products — a separate line of authority

Hawaii puts variable life and variable annuity products in their own line of authority under HRS § 431:9A-107(a)(5) — one of the eight the statute enumerates. Most states fold variable business into the life licence with a securities registration on top; Hawaii makes it a distinct authority on the licence.

There is no separate Hawaii examination for the variable line. The gate is your FINRA securities registration. But the structure is the tested point: life authority and variable authority are two different entries, not one.

Life settlements — 15 days to rescind

Hawaii regulates the secondary market under HRS chapter 431C. The number is the viator’s 15-day rescission window, running from the execution of the settlement contract (§ 431C-33(h)).

Annuities — best interest since 2023

Hawaii adopted the NAIC best interest standard by Act 58 of 2022, effective 1 January 2023, codified at HRS § 431:10D-623. A producer recommending an annuity must act in the consumer’s best interest rather than merely establishing suitability. Study material written before 2023 describes the older suitability regime — check the date on anything that frames the duty as “is this suitable.”
