Michigan’s life law is the national pattern with the trigger events moved. The concepts are the ones your national course taught, but Michigan starts several of the clocks somewhere else and hands the policyholder a stronger remedy at the end of one of them. Learn it as a set of relocated triggers rather than a set of new rules and it stays organized.
The free look — the clock starts at receipt, and the policy dies at the root
MCL 500.4015 requires not less than 10 days to return an individual life policy. Ten days is unremarkable; the Michigan details are not.
The period runs from the date the policyholder RECEIVES the policy — not from delivery, not from issue. The notice of that right must appear on the front page, and the refund includes any policy fee or other charge, not just premium. And on return the policy is void from the beginning, as if it had never been issued. Most states write their free look as a refund of premium; Michigan writes it as an unwinding of the contract.
Two extensions sit alongside it. MCL 500.4038(5) gives 15 days on a universal life policy delivered sooner than five days after the statement of policy information, and 4038(6) requires an unconditional refund provision of at least 10 days on a direct-response solicitation. Annuities carry their own version at MCL 500.4073(1) — 10 days from receipt, refund including any policy fee, void from the beginning — but 4073(3) carves out a contract issued to an employee funding a qualified plan where participation is a condition of employment.
Grace, pre-termination notice, and reinstatement
Read MCL 500.4012(a) as words rather than as a concept: “a grace period of 1 month.” Not thirty days. A calendar month — so February settles the matter, and the exam knows it. The insurance continues in force through it, any overdue premium is deducted from a settlement, and the grace may be subject to an interest charge, which most states’ provisions never mention.
A second, separate clock lives at MCL 500.4012(b): written notice to the policyowner’s last known address at least 30 days before termination, except for insurers that collect most premium in person. Candidates merge that 30 into the grace month — one keeps the coverage alive, the other warns before it ends.
Reinstatement is conventional: 3 years from default under MCL 500.4028, on evidence of insurability plus arrears with interest. Nonforfeiture is required by MCL 500.4024, which does not itself list the options — it points to the standards at MCL 500.4058, 4060 and 4061.
Incontestability — two years, and four exceptions
MCL 500.4014 makes a Michigan life policy incontestable after 2 years from the policy’s date, during the insured’s lifetime. Standard. The exception list is not: nonpayment of premiums; violations of provisions relating to naval or military service in time of war; and then, at the company’s option, provisions for total and permanent disability and provisions granting additional insurance against death by accident.
“At the company’s option” is doing the work: the carrier may keep contesting those two riders after the main policy has gone incontestable. A stem mentioning an accidental death benefit is fishing for exactly that.
The two outliers worth over-learning
MCL 500.4046(2) forbids a life policy from limiting the time to bring an action to less than 6 YEARS after the cause of action accrues. Most states track a two- or three-year floor, so a Michigan item offering “three years” is offering the national answer as bait. The same section bars backdating more than 6 months where the earlier date reduces the premium (4046(3)), and bars forfeiture for an unpaid policy loan until at least 1 month after notice to the insured and any assignee of record (4046(1)).
The other outlier is on the settlements side, under Michigan’s own act (MCL 550.521 et seq.). MCL 550.524(2) lets the viator void the contract for at least 30 days after signing, or 15 days after receiving the proceeds, WHICHEVER IS LESS — less, not the “later” instinct supplies. Once the money arrives, the fifteen-day clock can close the right well before thirty days from signing have run.
Finally, the annuity credential: MCL 500.4160(2) requires a one-time 4-credit best-interest course before you solicit any annuity, and the insurer must verify it before permitting a sale.
