Chapter Part 3 New Jersey Laws Specific to Life & Health
New Jersey regulates insurance inside a department that also regulates banks, and it writes its consumer protections with a distinctive hand — generous in some places, absent in others. For the combined exam, three areas repay study above all: the free-look regime, where New Jersey does something no other state does; the guaranty association, whose limits run above the NAIC model; and the training obligations, which are among the most specific in the country.
Who regulates — one department, two industries
New Jersey insurance runs through the Department of Banking and Insurance (DOBI) — a single department covering banking and insurance together, led by a Commissioner appointed by the Governor with the advice and consent of the Senate, serving at the Governor’s pleasure. Not elected. The law lives in Titles 17 and 17B of the New Jersey Statutes, with producer licensing in the Insurance Producer Licensing Act of 2001 and rules in Title 11 of the Administrative Code.
New Jersey does not split agents from brokers the way New York does. There is one credential — insurance producer — carrying whichever lines of authority you qualify for.
Free looks — and the one New Jersey doesn’t require

The annuity line is not a typographical error. DOBI stated in a rule adoption that it “has no statutory authority to regulate free review provisions for individual annuity contracts, variable or otherwise.” Most contracts voluntarily provide about ten days — but as a product feature, not a legal right.
And on the life side, resist the flat number: the regulation requires not less than 10 days and expressly permits far longer. A 30-day free look on a New Jersey life policy is perfectly lawful, so a question giving you the policy’s actual stated period is asking whether it complies, not whether it equals ten.
The guaranty association — New Jersey pays more than the model
Here national material will actively mislead you. The New Jersey Life and Health Insurance Guaranty Association (NJLHIGA) does not follow the NAIC model limits:

One more, easily overlooked: using the guaranty association’s existence — or its website — to advertise or induce a purchase is expressly prohibited (N.J.S.A. 17B:32A-17).
Training — New Jersey is specific where most states are vague
Two product-specific obligations sit on this side of the house, and both carry real hour figures:
- Annuities. A one-time four-hour best-interest course, under the NAIC 2020 standard New Jersey adopted effective 21 April 2025 (N.J.A.C. 11:4-59A). Producers already holding a Life authority on that date had until 21 October 2025 to comply.
- Long-term care. Eight hours initially, then four hours every 24 months (N.J.A.C. 11:4-34.29). The producer must already hold life or accident-and-health authority, and the training may not be insurer- or product-specific.
Both count toward the standard 24 credits per two-year term, three of them professional ethics — and that 24 is per licensee, not per line. Holding Life and Accident & Health does not make it 48.
