Chapter Part 3 New Mexico Laws Specific to Life Insurance
New Mexico’s life policy provisions are set out in Chapter 59A with specific numbers attached, and those numbers are what the state-specific half of the exam is built on. Fixed intervals are learnable, and they are worth learning precisely because they are the part of the syllabus where a state can differ from the national textbook.
The intervals the statute fixes
Start with the two-year pair, because they are easy to confuse and both appear on the exam. Incontestability runs two years from the date of issue, during the insured’s lifetime (§59A-20-5). The suicide provision also turns on two years from issue, but read it carefully: §59A-20-25(A)(2) says a policy may contain a provision excluding or restricting coverage for death by suicide within two years. The statute caps how far such an exclusion may reach; it does not require one. A question asking whether a New Mexico policy must exclude suicide is testing exactly that.
The grace period for individual life is 30 days — or, at the insurer’s option, one month of not less than 30 days (§59A-20-4). The same section carves out four weeks for industrial life policies whose premiums are payable more frequently than monthly, which is worth filing next to the industrial-life point below.
Reinstatement — where the industrial life carve-out hides
A lapsed New Mexico life policy may be reinstated within three years of premium default, on evidence of insurability and payment of arrears (§59A-20-12). But the same section shortens that window to two years for industrial life, and that carve-out is the single most reliable trap in this part of the syllabus. National prep teaches a flat three-year rule.
The second half of §59A-20-12 is just as testable: overdue premiums on reinstatement bear interest not exceeding 6% per year, compounded annually. This is standard-policy-provision language rather than a New Mexico peculiarity, but the exam still asks for the ceiling and the compounding basis.
Free look — one number here, a different number next door
Be careful here, because the number most often repeated is not a New Mexico mandate. 13.9.5 NMAC is the Life Insurance Disclosure rule, and its only ten-day reference is conditional: 13.9.5.9(A) lets an insurer deliver the Buyer’s Guide with the policy instead of before accepting premium if the policy contains an unconditional refund provision of at least 10 days. Where New Mexico genuinely mandates a period, it is longer: a replaced life policy or annuity carries 30 days (13.9.6 NMAC), and long-term care carries 30 days under §59A-23A-6(E). Replacement is the trigger for the longer window.
Nonforfeiture and the annuity standard
The Standard Nonforfeiture Law (§59A-20-31) requires a cash surrender value and a paid-up nonforfeiture benefit on a plan stipulated in the policy, one of which operates automatically unless another available option is elected. In practice the options presented are the familiar cash surrender value, reduced paid-up insurance and extended term insurance — but note the statute frames it as cash value plus a stipulated paid-up benefit rather than as three co-equal statutory choices.
On the annuity side, New Mexico adopted the NAIC 2020 best-interest revision to the Suitability in Annuity Transactions rule (13.9.20 NMAC). That is the current standard, and it is a higher bar than the older suitability-only formulation still printed in some manuals.
Two boundaries of the licence itself
Annuities are sold under the Life line — there is no separate fixed-annuity licence here. But variable life and variable annuity products are a separate line, requiring the Life licence plus FINRA and SEC securities registration. New Mexico publishes no variable-products examination because it relies on the federal registration instead.
New Mexico also regulates the secondary market: the New Mexico Viatical Settlements Act (§59A-20A) governs viatical and life settlements, and gives the viator a rescission window of at least 15 days from receipt of the proceeds. The contract is deemed rescinded if the insured dies within that period.
