Chapter Part 3 New Mexico Laws Specific to Personal Lines
Personal lines is where a state’s consumer-protection rules bite hardest, and New Mexico’s are unusually granular. Two areas carry almost all the state-specific weight: the cancellation timetable, which uses four different notice periods, and the credit-information statute, whose whole meaning turns on a single word.
Cancellation — four clocks, and you must know which one is running
New Mexico treats the first sixty days of a policy differently from everything afterwards.
Inside the first 60 days, a policy may be cancelled for any reason on at least 10 days’ notice (§59A-18-29). This is the underwriting window, and the insurer needs no stated cause.
After the first 60 days, the rules tighten considerably. Cancellation requires at least 15 days’ written notice, and the notice must state an enumerated reason (13.8.4.8 NMAC). The enumerated causes are: material misrepresentation or fraud, wilful or negligent acts increasing the hazard, revocation or suspension of the driver’s licence of the named insured or another household member or regular operator, or a fraudulent claim. Note the licence in question is a driver’s licence, not an insurance licence. A substantial change in the risk requires 30 days’ notice rather than fifteen.
Two more periods complete the set. Cancellation for nonpayment of premium takes at least 10 days’ written notice (§59A-18-29) — the same short period as the initial window, whenever it occurs. And nonrenewal requires at least 30 days’ written notice (13.8.4.9 NMAC).
Notice what the sixty-day boundary really does. Before it, the insurer owes a short notice and no explanation. After it, the insurer owes a longer notice and a reason drawn from a closed list. That shift — from freedom to justification — is the concept behind the numbers, and holding it makes the four periods much easier to keep straight.
Credit information — the whole question is the word “solely”
New Mexico permits credit-based insurance scoring in personal lines, with restrictions, under the Personal Insurance Credit Information Act (§59A-17A-4). Candidates lose this question in both directions: some answer that New Mexico bans credit scoring, others that it is unrestricted. Both are wrong.
The statute does two distinct things.
First, it forbids the use of certain factors outright: an insurer may not use income, gender, address, race, colour, national origin, religion, or marital status.
Second — and this is the tested half — an insurer may not decline, cancel, nonrenew, or rate solely on credit without other underwriting factors. Credit may inform the decision. It may not be the decision.
What this licence actually is
One structural point, because competitor material states it wrongly. Personal Lines is a line of authority in its own right, listed by statute at §59A-12-17(A)(6) as “personal lines property and casualty insurance coverage sold to individuals and families for primarily noncommercial purposes,” and it has its own examination — Series 18-38, 100 items in two hours.
Full Property and Casualty authority is broader and reaches personal-lines risks too, so P&C is a superset of what you may write. But Personal Lines is not a subdivision of a P&C licence; the two are separately granted qualifications.
