Chapter Part 3 Washington Laws Specific to Life & Disability Insurance
Two subjects carry this paper because they cross both lines: the free-look ladder and the guaranty association. National material gets the first wrong by omission — plenty of Washington outlines say the state mandates no life free look, which is false — and the second wrong by arithmetic, adding category caps the statute forbids you to add.
The free-look ladder — five numbers, keyed to different events
Washington keys different return periods to different starting events. Learn the event with the number.
- Individual life: 10 days, running from receipt of the policy by the policy owner (RCW 48.23.380(1)).
- Replacement of a life policy or annuity: 20 days from the date of delivery, an unconditional refund of all premiums paid — and it is the replacing insurer’s duty to provide that right in the policy or in a separate notice delivered with it (WAC 284-23-455(4)).
- Individual disability: 10 days from delivery, same 10% late-refund penalty; single premium nonrenewable policies are excluded (RCW 48.20.013).
- Medicare supplement: 30 days from delivery, individual policies and group certificates alike (RCW 48.66.120(1)).
- Long-term care: 30 days after delivery, for any reason — plus a second 30-day clock on the insurer to make the refund or deny the application (RCW 48.83.060(1), (3)).
Now the detail almost nobody teaches. RCW 48.23.380(1) adds an additional 10% penalty to any life premium refund not paid within 30 days of the policy’s return, and makes a returned policy “void from the beginning and the parties shall be in the same position as if no policy had been issued.” The life free look does not reach policies issued in connection with a credit transaction or under a contractual change or conversion privilege (RCW 48.23.380(1), (2)).
Why chapter 48.23 makes it look as though there is no life free look
RCW 48.23.020 requires the standard provisions found in RCW 48.23.030 through .130. A reader working that chapter in order sees grace, entire contract, incontestability and reinstatement — no return period — and concludes Washington mandates none. The free look is at RCW 48.23.380, outside the incorporation range. It exists; it is simply not where the reader was looking.
The guaranty association — $500,000, and then $500,000 again
The Washington life and disability insurance guaranty association applies $500,000 to the life death benefit, to net cash surrender and net cash withdrawal values, to disability income, to health benefit plans, to long-term care, and to the present value of annuity benefits — all in the coverage-and-limitations section at RCW 48.32A.025(3)(b)(i), not in the definitions section at RCW 48.32A.045, which carries no dollar figure at all.
Now the trap. Six categories at $500,000 invites a candidate to add a death benefit to an annuity and answer $1,000,000. RCW 48.32A.025(3)(b)(iv)(A) caps the obligation at $500,000 with respect to any one life across the categories. The buckets do not stack.
And the caps are ceilings, not entitlements. Subsection (3) opens the scheme as a “lesser of”: the association never owes more than the member insurer’s contractual obligation. A $200,000 policy is a $200,000 claim, not a $500,000 one.
Two other figures worth carrying: $100,000 for each individual in a governmental retirement plan under IRC 401, 403(b) or 457 covered by an unallocated annuity contract — the one per-person figure that is not $500,000 (RCW 48.32A.025(3)(b)(ii)) — and $5,000,000 for one owner of multiple nongroup life policies (RCW 48.32A.025(3)(b)(iv)(B)).
Replacement and twisting — learn the actor before the number
Every numeric clock in Washington’s replacement rule belongs to an insurer. WAC 284-23-455 gives the replacing insurer 3 working days to notify each existing insurer, the existing insurer 20 days to furnish a policy summary on a conservation, and 5 working days to answer a request for one (WAC 284-23-455(2)(b), (2)(c)).
The producer has no clock at all. The only producer timing duty is qualitative: present a completed notice regarding replacement “not later than at the time of taking the application,” get it signed, and leave the signed original with the applicant (WAC 284-23-440(2)(a)). Memorise “three working days” and pin it to the producer and you have the wrong party.
Finally, twisting. Washington’s definition at RCW 48.30.180 is broader than the model and short enough to quote whole: “No person shall by misrepresentations or by misleading comparisons, induce or tend to induce any insured to lapse, terminate, forfeit, surrender, retain, or convert any insurance policy.” Retain means an abusive conservation effort — talking a client out of a replacement by misrepresenting it — is twisting here. Tend to induce means the attempt is enough.
