Alaska’s life provisions look like the NAIC model until you read the second half of each sentence. The grace period splits. The reinstatement window splits. The free look triples the moment a transaction becomes a replacement. Learn the baseline, then learn the four places Alaska qualifies it, and the Alaska section of the Life exam becomes a short list rather than a chapter.
The core provisions — and where each one forks
An Alaska individual life policy is incontestable after two years from the date of issue, during the insured’s lifetime (AS 21.45.040). The grace period is 30 days, or one month of not less than 30 days — except four weeks for industrial life policies whose premiums are payable more frequently than monthly (AS 21.45.030). A lapsed policy may be reinstated within three years of premium default — except two years for industrial life — and the insurer may charge back premiums with interest not exceeding 6% a year, compounded annually (AS 21.45.110).
The suicide clause — read the exact words
The suicide exclusion runs two years from the date of issue, and AS 21.45.250 states it in language worth memorizing verbatim: death as a result of suicide “while sane or insane.” That phrase closes the argument that an insured lacked capacity, and a question quoting it is testing whether you recognize Alaska’s statutory wording rather than the general concept.
Free looks — 10 days, until it is a replacement
The ordinary free look is 10 days after delivery, with a full refund, and AS 21.45.020(c)(2) expressly covers annuity contracts as well as life policies — there is no separate annuity number to remember. Then comes the fork: where the transaction is a replacement, 3 AAC 26.805(a)(5) gives the owner 30 days to return the policy or contract, unconditionally, with a full refund of all premiums including any fees or charges (or cash surrender value plus fees for a variable or market-value-adjusted product).
Replacement — the read-aloud duty
Alaska imposes an obligation on the producer that most states do not. Under 3 AAC 26.795 you must give the applicant a replacement notice conforming to the regulation’s Appendix A and read that notice aloud to the applicant before or at the time of application, unless the applicant declines to have it read. Both the applicant and the producer sign certifying that it was read aloud or declined, along with a statement of whether the applicant has existing coverage. You keep that statement and your sales material for five years, and the replacing insurer must notify the existing insurer within five working days.
Nonforfeiture and variable products
The Standard Nonforfeiture Law (AS 21.45.300, .305) requires the familiar three: cash surrender value, a paid-up nonforfeiture benefit, and extended term insurance. Variable life and variable annuities are a separate Alaska line of authority that sits on top of the Life line — you need life authority first, plus a FINRA registration number — and there is no additional Alaska state exam for it.
Annuities — best interest, in regulation
Alaska adopted the NAIC best-interest standard by regulation effective 23 November 2022: when recommending an annuity, a producer must act in the consumer’s best interest without placing the producer’s or the insurer’s financial interest ahead of the consumer’s (3 AAC 26.775(a)). The four obligations are care, disclosure, conflict of interest and documentation. Before you may recommend an annuity at all, you must complete a one-time four-credit-hour annuity training course approved by the director (3 AAC 26.778(b)).
