Terms of Service

These terms govern your use of testivity.com and the TESTivity study tools and courses ("the Services"), operated by TESTivity, 415 S Dixie Dr #10, Saint George, UT 84770. By using the site or purchasing a product, you agree to these terms.

What we are — and aren't

TESTivity provides exam preparation: study materials, practice questions, and courses that help you prepare for state insurance licensing exams. We are not affiliated with any state government agency, insurance department, or exam vendor (such as Pearson VUE, PSI, or Prometric), and we do not issue licenses or administer official exams. Licensing requirements are set by the states and change; while we verify our information on a schedule and cite our sources, always confirm current requirements with your state's insurance department before acting on them. Our content is educational material, not legal or financial advice.

Your license to the materials

When you purchase a TESTivity product, you get a personal, non-transferable license to use it for your own exam preparation. All materials — courses, practice questions, cheat sheets, mind maps, audio, and video — are our copyrighted work. You may not share account access, redistribute, resell, republish, or use the materials to build a competing product. Watermarked samples we publish are for evaluation only.

Purchases and payment

Prices are in U.S. dollars and purchases are one-time payments — no subscriptions, processed by Stripe. Access is granted to the email address used at checkout, for the state and license line you select. We may correct pricing errors on the site; if a price was in error at the time of your order, we will contact you before proceeding.

Refunds and the Pass Guarantee

Platinum's Pass Guarantee: complete the full Platinum system — finish the course modules with a readiness score above 70% and complete at least three full-length simulated exams — then take your exam, and if you don't pass, we refund you in full upon submitting your exam result.

Because our products are digital and delivered instantly, other purchases are generally non-refundable except as required by law. That said, if something is wrong — a technical problem, a duplicate charge, a purchase for the wrong state — contact us at support@testivity.com and we will make it right.

No guarantee of exam results

Apart from the defined Pass Guarantee refund, we make no promise that you will pass your exam or obtain a license — that depends on your preparation and your state's requirements. Statements about typical outcomes are informational, not a warranty.

Affiliate disclosure

Matt Williams, the subject-matter expert behind TESTivity's courses, is also the subject-matter expert behind courses offered by Achievable (achievable.me). TESTivity has an affiliate agreement with Achievable: if you follow a link from our site to Achievable and purchase a product, we may be compensated. This does not change the price you pay, and we only link to products we believe in.

Accounts and acceptable use

Keep your account credentials to yourself; you are responsible for activity under your account. Don't attempt to scrape, copy at scale, disrupt, or gain unauthorized access to the Services. We may suspend accounts that violate these terms, with a refund of unused purchases at our discretion where the violation was not willful.

Disclaimers and limitation of liability

The Services are provided "as is." To the fullest extent permitted by law, TESTivity disclaims implied warranties and is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Washington County, Utah, unless applicable law provides otherwise.

Changes

We may update these terms; material changes will be reflected in the "Last updated" date above. Continued use after changes take effect constitutes acceptance.
